1. General

These terms and conditions and any other related rules adopted by Kaveity FZC and made available as provided herein (collectively the “Conditions of Sale”) apply to all products that you (“client” or “you”) may order from Kaveity FZC (“Atelier Kaveity”, “us”, “our”  “we”) via www.atelierkaveity.com and/or any related mobile or digital application or our social media channels or our customer service center (digital platform). In the case you want to place an order you will be required to indicate your acceptance of our Conditions of Sale by checking the “I have read and I accept the Conditions of Sale” box. Customers using our customer service center will be provided with access to our Conditions of Sale as set forth in the order confirmation.  Your acceptance of our Conditions of Sale is required in order to place an order. In the case you agree to our Conditions of Sale you will be deemed to have agreed to all conditions incorporated as set forth herein, including our Privacy Policy and Legal Terms and Conditions. Your agreement to our Conditions of Sale is binding when your order has been placed.

Atelier Kaveity may modify the Conditions of Sale any time at its sole discretion. Please read our Conditions of Sale on a regular basis and please read our Conditions of Sale prior to placing an order, to be well informed. Your continued use and/or registration will signify your agreement to be bound in the future by our modified Conditions of Sale. If you do not agree to any change to our Conditions of Sale, you must immediately contact our customer service center to cancel your registration and refrain from ordering any Atelier Kaveity product.

2. Eligibility to purchase

Solely individuals who have reached the age of majority and have legal capacity to enter into a contract may order Atelier Kaveity products. A parent or guardian must represent an individual who is under the age of majority and/or otherwise cannot lawfully enter into a contract. In the case that the individual is of the age of minority, the parent or guardian must place an order on their behalf and thereby agree to our Conditions of Sale. Any order(s) placed in violation of this provision shall be null and void. By placing an order, you represent and warrant that you are a bona fide end-user customer and will not deliver, sell or otherwise distribute Atelier Kaveity products or purchase Atelier Kaveity products for commercial purposes or any other commercial benefit.

3. Placing an order and check out

You may place an order by emailing our customer service center. We require to receive your full name, email address, phone number and address for delivery. You will be sent payment details on the invoice along with our Conditions of Sale. Once you have checked out, we shall ship your order. Please refer to our Privacy Policy for more details about how we may use your personal information.

4. Orders

Atelier Kaveity reserves the right to refuse, cancel and terminate orders at its sole discretion and may limit the quantity Atelier Kaveity products ordered per purchase. Atelier Kaveity further reserves the right to refuse at its sole discretion without prior notice, orders exceeding a certain number of items.

5. Pre-orders

Our digital platform provides you with information about products that are currently available for purchase, or pre-order. If you have opted to pre-order, your product will be sent to you within maximum thirty (30) days since the purchase date.

6. Availability of products

Atelier Kaveity offers new or secondhand horse saddlery, tack & more. New products are mentioned as “NEW”. All orders placed on our digital platform are subject to availability and acceptance by us. Without prior notice, we reserve the right to change the assortment of products offered. Our digital platform provides you with information regarding products that are currently available for purchase. Please contact our customer service center should you need further information about product availability.

7. Price and tax policy

We reserve the right to modify prices and delivery costs at any time, without prior notice. The applicable purchase price will be the price as calculated once placing your order and will not vary after any price modification. The sales tax associated with your purchase will be calculated at the time when your order is shipped, at which point you will receive a Confirmation of Order. Please note that changes to applicable law between the date your order is placed and the date the product is sent may result in changes to the sales tax associated with your purchase. If the resulting change is an increase in the sales tax, we will contact you and ask that you reconfirm your purchase. Please note that your financial institution may charge an exchange rate fee depending on the currency and exchange rate of your domicile country.

8. Payment

Atelier Kaveity accepts payment using PayPal or a bank wire transfer.

8.1 PayPal

For payment using PayPal, please use the information provided on the invoice. You will be required to enter your login details according to your registration with PayPal. Your financial institution may charge an exchange rate fee depending on the currency and exchange rate of your domicile country.

8.1 Debit/Credit Card

Atelier Kaveity accepts the following credit cards: Visa, MasterCard and American Express. Your debit card should also include Visa, MasterCard or American Express. When placing an order on our website you will be required to enter your payment details such as name, credit/debit card number and your security code displayed on the front or back of your debit/credit card. Information containing your credit card information will be fully encrypted and only used to process card transactions. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment, you will need to contact your card issuer directly to solve this problem. We will not be liable for refusal of payment by your debit/credit card issuer and any delay or non-delivery. To process your order, we may perform security checks on your credit card. The full amount of your purchase will be blocked on your credit card until we approve your order. By submitting an offer to purchase our products you expressly authorize Atelier Kaveity to perform security checks where Atelier Kaveity deems necessary to transmit or to obtain information about you or from third parties to authorize individual purchase transactions by authenticating your identity, validating your debit/credit card and obtaining debit/credit card authorization. Please note that your financial institution may charge an exchange rate fee depending on the currency and exchange rate of your domicile country.

8.2 Bank Wire Transfer

We accept bank wire transfer for orders placed through our digital platform. Our bank details are mentioned on the invoice. Please provide us with the invoice number in your transaction. Your financial institution may charge a fee for payment using a bank wire transfer. Your financial institution may also charge an exchange rate fee depending on the currency and exchange rate of your domicile country. Your order will be processed once the bank wire transfer payment has been received and confirmed by us. If your wire transfer payment is not credited into our bank account within fourteen (14) days after you have placed your order, your order will be cancelled. Please refer to our Privacy Policy and Legal terms and conditions for more details about our measurements to safeguard your personal information

9. Confirmation of Order and Sales Agreement

Following approval of the anti-fraud, security and legal checks, Atelier Kaveity will email you the Confirmation of Order. The written Confirmation of Order constitutes the acceptance of your order by us and indicates the existence of a binding sales contract. The Confirmation of Order emailed to you is deemed to be received, when you are able to access them on your computer, mobile or handheld device. The Confirmation of Order is proof of a binding agreement between you and Atelier Kaveity. You may at any time later request a copy of the invoice or Sales Agreement by contacting our customer service center. We may request that you provide proper identification as a condition to complying with such request.

10. Shipping policy

Your order will be shipped to you within three (3) days since the Confirmation of Order. Depending on the uniqueness of your product, shipment may take longer. In that case, you will be contacted by an Atelier Kaveity Ambassador.

Atelier Kaveity uses DHL Express applying the shipping rates as set out below. The DHL Express shipping service does not ship to a P.O. Box. Please provide us with a physical address. When placing an order, you will be required to provide personal information as applicable, such as shipping address, billing address and payment details. You represent and warrant that the personal information you provide on our website or to our customer service center is true, valid, complete and up to date. Unless the item is a gift, you confirm that you are the person referred to in the shipping and billing information provided.

Atelier Kaveity ensures that your purchase is delivered to you from the time it is in transit until delivery. We require a signature by an adult to confirm your acceptance of your purchased Atelier Kaveity item(s), at which point responsibility for your purchased item(s) passes to you. If you have specified a recipient for delivery, for example when it is a gift, then you accept that evidence of a signature by the recipient or at that delivery address is evidence of delivery and fulfillment of the sales contract by Atelier Kaveity and transfer of responsibility to the recipient.

Estimated delivery times

Atelier Kaveity uses the DHL Express shipping service with an estimated delivery time of 3 business days. Orders will be delivered on a business day. Saturday and national holidays will not be considered as a regular business day with respect to estimated delivery lead time. Delivery on Saturday may however be proposed as a service to specific zip codes by our customer service center. This service as well as express shipping may incur more charges. When estimating the package delivery time, please allow time for credit approval, address verification and order processing. Once the order is processed and ready for shipment, we will send you the Confirmation of Order by email. When ordering on our e-Boutique or through our customer service center, you will receive an email notification with the tracking information related to the delivery of your order. Please contact our customer service center for more information.

Package content

Each delivery package will contain, in addition to your purchased Atelier Kaveity item: (I) any related accessories and (II) if requested by you, printed gift note(s) containing your message.

11. Cancellation policy

The processing of our orders is fully automated. Once you have placed your order, you have twenty-four (24) hours to cancel your order. Please note that once your order is placed, it cannot be cancelled outside the twenty-four (24) hour period.

12. Return policy

All returns and exchanges are subject to the further terms and conditions set forth below.

General exchange policy

Atelier Kaveity item(s) purchased on www.atelierkaveity.com or through our customer service center may either be exchanged or returned for a credit note within thirty (30) days following delivery. Atelier Kaveity products are not eligible for a refund. All returns will be subject to a Quality Control check by Atelier Kaveity to ensure that the returned items satisfy the requirements as set forth herein. If the items do not meet the Quality Control standards, Atelier Kaveity will refuse the return and the item will be sent back to the client or the gift recipient. These shipping costs will be paid by the client. If the returned item satisfies the Quality Control, Atelier Kaveity will proceed with the applicable exchange. Once we have processed your return, Atelier Kaveity will email the invoice which specifies the value of the returned item, the price of the item for which the original item has been exchanged and the difference to be paid by the client or the amount that the client is entitled to receive as a credit note. If the returned item is less expensive than the exchanged item, the gift recipient will be charged the difference in price.

Conditions to exchange an Atelier Kaveity item

Atelier Kaveity items must be returned in its original packaging. Atelier Kaveity items must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them, as well as with the original Atelier Kaveity box and delivery package, including all accessories and documents. Atelier Kaveity will not accept any return if the item shows signs of wear or has been used or altered from its original condition in any way.

Atelier Kaveity items not eligible for exchange or refund

  1. Items that show signs of use or tear;
  2. Personalized items, such as a personalized art piece; and
  3. Special orders, such as a custom-made art piece.

13. Defective items

Atelier Kaveity is extremely cautious in ensuring that each item strictly complies with its Quality Control requirements and that it has passed all our controls, both technical and aesthetic. If nevertheless you receive an Atelier Kaveity item that seems to be damaged, you may return the Atelier Kaveity item in accordance with our return policy.  Please contact our customer service center after which a Client Ambassador will reach out to you immediately to advise and assist you the best possible way and to propose the best solution. Upon receipt, Atelier Kaveity may classify the returned item as defective. Please note that items that are damaged as a result of wear and tear are not considered defective. If your Atelier Kaveity item is declared defective by us, we may send you the same item in the exact same size, or we may propose an exchange for another Atelier Kaveity item of equivalent or higher value (in which case the initial price will be deducted and you will be required to pay the difference) or may offer you a credit note of equivalent value or we may offer you a repair.

14. Privacy Policy

Atelier Kaveity takes administrative and technical precautions to safeguard your personal information against loss, theft, and misuse, as well as against unauthorized access, encryption on all web pages where personal information is collected. Unfortunately, transmitting information over the Internet is not completely secure. Although we will implement appropriate measures to protect your personal information, we cannot guarantee the security of the data you transmit; any transmission is at your own risk and Atelier Kaveity cannot be held liable. These Conditions of Sale is subject to our Legal terms and conditions as set forth therein.
